Terms of Service

You must be at least 18 years old and able to form a binding contract. Membership is by application and review, and is offered at our sole discretion. You agree to provide accurate, current, and complete information, to keep it up to date, and to maintain only one account. You are responsible for your account and for keeping your password secure.

No account is created instantly, and no profile is self-published. Applying requires structured, verifiable information — not a free-form profile — and your application is held in a pending state, invisible to every other member, until we act on it. A member of our team personally reviews every application, including every photo and every field, before it is approved. Approval and identity verification (see “Identity & background verification” below) are both required and neither substitutes for the other — until both are complete, you cannot be introduced to, browsed by, or matched with another member. A paid membership fee does not accelerate or substitute for this review. Email addresses are unique per account, consistent with the one-account rule above.

No one is added to First Class, matched, or contacted without their own affirmative action. An account can only be created by the person themselves — no third party may register, submit, or maintain a profile on someone else's behalf, and profile content (including photos) can only be added or changed by the authenticated account owner. An introduction never connects two members automatically: the receiving member must personally open and respond to it, and declining is a fully respected outcome, not something we route around. Consent to these Terms, our Acceptable Use Policy, and identity/background screening is a separate, explicit, timestamped step at registration, and SMS consent uses an unchecked-by-default control with a logged proof-of-consent record (timestamp, IP address, and the exact consent text shown) — never inferred or bundled into another action. You may withdraw at any time: block another member or end an active match to cut off further contact immediately, hide your own profile from all matching and browsing, or delete your account outright — though we may briefly hold a deletion request while a report about you is under active investigation, so evidence isn't lost mid-review. Profiles are never publicly searchable and are shown only through a specific, matchmaker-curated introduction — never through open browsing by strangers.

First Class is a concierge matchmaking service. We review applicants, curate potential introductions, and facilitate them with discretion. Matchmaking is inherently subjective. We do not guarantee that you will receive any particular number of introductions, that anyone will accept an introduction, or that any introduction will result in a match, relationship, or marriage. We provide the service on a reasonable-efforts basis.

Some memberships require a fee. Current tiers and prices are published on our Membership & Pricing page, and fees and any renewal terms are disclosed to you before you pay. Payments are handled by our processor (Stripe) or arranged with our concierge. Refunds, renewals, and cancellations are governed by our Refund Policy, which is part of these Terms. Unless that policy, the law, or a writing from us at the time of purchase says otherwise, fees are non-refundable. You are responsible for any applicable taxes.

For the safety of the community, members undergo identity verification and background / watchlist screening through our provider, Persona, and you consent to this as part of joining. Screening has real limits: it relies on available records and is nota guarantee of any person's identity, character, criminal history, or safety. See our Safety page.

These rules, together with our Acceptable Use Policy (which is incorporated into and forms part of these Terms), govern how the service may be used. You agree that you will not:

• Provide false, misleading, or impersonated information, or misrepresent your identity, age, marital status, or intentions.
• Harass, threaten, stalk, abuse, defame, or discriminate against anyone, or behave unlawfully toward another member — online or in person.
• Solicit money, investments, gifts, or commercial dealings from other members, or use the service for any commercial or promotional purpose.
• Share, publish, or misuse another member's private information, photos, or communications.
• Attempt to access accounts or data that are not yours, or disrupt, probe, or reverse-engineer the service.

First Class is a matchmaking service for genuine relationships, not a venue for commercial or illegal activity. You must not use the service, your profile, messages, or any introduction to:

• Offer, solicit, arrange, or engage in prostitution, escorting, sex work, or any exchange of money, gifts, or things of value for sexual or romantic companionship.
• Engage in, facilitate, aid, abet, or encourage human trafficking of any kind — including sex trafficking and sexual exploitation — or coercion, or any activity involving a minor (the service is strictly for adults 18+).
• Abuse, exploit, or endanger any person, or aid, abet, encourage, or conceal the abuse or exploitation of any person.
• Commit or facilitate fraud, money laundering, romance scams, extortion, theft, or solicitation of financial support or investment.
• Distribute unlawful, non-consensual, or sexually explicit content, or threaten or incite violence.
• Violate any applicable law, regulation, or the rights of others.

We enforce this with zero tolerance. Violations may result in immediate suspension or removal without refund, and we may report suspected illegal activity to, and cooperate with, law enforcement and preserve relevant records for that purpose. Nothing in these Terms requires us to monitor conduct, and we are not responsible for members who break these rules — but we act on credible reports.

First Class does not employ, supervise, or control members and is not responsible for the conduct of any member, online or in person. Identity and background verification (see the Safety page) reduces risk but is not a guarantee of anyone's identity, character, criminal history, or safety.

You understand that interacting and meeting other people involves inherent risks — including the risk of dishonesty, offensive or unlawful conduct, emotional or physical harm, injury, sexual misconduct, theft, or other loss — and you knowingly and voluntarily assume all such risks. You are solely responsible for your own interactions and decisions and agree to exercise caution and good judgment, especially when meeting in person.

To the fullest extent permitted by law, you release and hold harmless FCM Solutions LLCand its owners, staff, and agents from any claims, demands, damages, or liabilities of every kind arising out of or connected with another member's acts or omissions, your interactions or meetings with any member, or any information a member provides — whether occurring online or in person. Some jurisdictions limit the release of certain claims (for example, for gross negligence or willful misconduct); this release applies only as far as the law allows.

If a member behaves inappropriately or unlawfully, tell your matchmaker or use the in-app “Report a concern” option, or write to hello@matchfirstclass.com. We may investigate, suspend or remove members, preserve records, and cooperate with law enforcement — our Law Enforcement Guidelines describe how we handle official requests. If you are in immediate danger, contact your local emergency services first.

You retain ownership of the photos and information you submit (“Content”). You grant us a limited, non-exclusive license to host, store, and use your Content solely to operate the service — including showing appropriate details to your matchmaker and, when you are introduced, to the specific member involved. You represent that you have the right to share your Content and that it does not infringe anyone's rights. We may remove Content that violates these Terms.

Discretion is the heart of First Class. Information you learn about other members through the service is confidential. You agree not to disclose, screenshot, publish, or otherwise misuse it.

The service, including our name, marks, design, and content (other than member Content), belongs to FCM Solutions LLC and is protected by law. We grant you a personal, non-transferable, revocable license to use the service for its intended purpose.

You may close your account at any time from your dashboard. We may suspend or terminate your account if you violate these Terms, if verification cannot be completed, or to protect the community. Sections that by their nature should survive termination will do so.

The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that any introduction will meet your expectations.

To the fullest extent permitted by law, FCM Solutions LLC and its personnel will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or the conduct of any member. Our total liability for any claim relating to the service will not exceed the amount you paid us in the twelve months before the claim.

You agree to indemnify, defend, and hold harmless FCM Solutions LLCand its owners, staff, and agents from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the service, your Content, your interactions or meetings with other members, or your violation of these Terms, of any law, or of another person's rights.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules. Any dispute will be resolved in the courts or by the dispute-resolution method specified for that jurisdiction.

By providing a mobile phone number and opting in, you consent to receive text messages from us related to your account and the service — such as new-match alerts, messages from your matchmaker, password-reset links, account and application status updates, and — for Noir members — house account and private-event updates. Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out, or HELP for help. We are not liable for delayed or undelivered messages caused by your carrier. You may also opt out by removing your phone number from your account settings.

By using the service, you consent to receive communications and legal notices from us electronically, and you agree that electronic records and signatures satisfy any legal requirement that such communications be in writing.

We may update these Terms from time to time. We will post the new version here and update the date above; material changes will be communicated to members. Continued use after changes take effect means you accept them.
